These Terms of Service ("Terms") govern your access to and use of sunkissed.shop and the purchase of products from SunKissed Garden Co. ("SunKissed", "we", "us"). By using the site or placing an order you agree to these Terms.
1. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to place an order.
2. Products & pricing
We do our best to display accurate product images, descriptions, and prices. Colors may vary slightly due to monitor settings. Prices are listed in USD unless otherwise indicated and may change without notice. We reserve the right to refuse or cancel orders at our discretion (for example: pricing errors, suspected fraud, or stock issues) and will refund any payment in full.
3. Orders & payment
Placing an order constitutes an offer to buy. The order is accepted when we send a shipment confirmation. Payment is processed by our payment providers (Shopify Payments, Shop Pay, Apple Pay, Klarna). All payments are final at the time of purchase.
4. Shipping
Shipping terms are described on our Shipping page. Title and risk of loss pass to you when the carrier accepts the package.
5. Returns & refunds
Returns are governed by our 60-day return policy. Items must be in resalable condition unless damaged or defective.
6. Warranty
SunKissed products carry a 1-year limited warranty against manufacturing defects, in addition to the 60-day money-back guarantee. The warranty does not cover damage from misuse, accidents, or normal wear (e.g., faded paint after years of UV exposure).
7. Intellectual property
All content on sunkissed.shop — including logos, product designs, photos, copy, and the SunKissed™ name — is owned by or licensed to SunKissed Garden Co. and protected by copyright and trademark law. You may not reproduce, distribute, or create derivative works without our written consent.
8. Acceptable use
You agree not to use the site for unlawful purposes, to attempt unauthorized access, to transmit malware, or to scrape or copy content for competitive use.
9. Disclaimer & limitation of liability
The site and products are provided "as is". To the fullest extent permitted by law, SunKissed disclaims all implied warranties beyond those required by law, and our total liability for any claim arising from your purchase is limited to the amount you paid for the product.
10. Indemnification
You agree to indemnify SunKissed against any claim arising from your breach of these Terms or misuse of the site or products.
11. Governing law
These Terms are governed by the laws of the State of New York, USA, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts of New York County, New York.
12. Changes
We may update these Terms from time to time. Continued use of the site after changes are posted constitutes acceptance.
